Supreme Court India — The May 2026 Ruling That Changed Everything

On May 27 2026 a two-judge bench of the Supreme Court of India delivered a landmark judgment in the case of Directorate General of GST Intelligence versus Gameskraft Technologies. The ruling held that online real-money games played on uncertain outcomes constitute betting and gambling — regardless of whether the game is framed as a game of skill or chance.

This judgment ended the primary legal defence that every real-money prediction and fantasy sports platform had relied on for years. The skill versus chance argument, which platforms like Dream11, Probo, and MPL had used to justify their operations, was explicitly rejected.

The court also validated the 28% GST on the face value of player deposits, resulting in tax demands totalling nearly Rs. 2.5 lakh crore across the industry. Following the ruling, major platforms including Dream11, MPL, PokerBaazi, and Zupee suspended real-money operations. The Indian gaming industry as it existed before effectively ceased to operate.
